    Welcome, and thanks for choosing Sapphire HVAC Solutions Inc. These Terms and Conditions ("Terms") explain how we work with you, what you can expect from us, and what we ask of you in return. They apply to our website at sapphirehvac.net, to any service you request from us, and to any calls, emails, or text messages between us.

    By using our website, requesting an estimate, scheduling service, or giving us your phone number or email address, you agree to these Terms. If you do not agree with them, please do not use our website or request service from us.

    Please read Section 14, Text Messaging Terms, closely. It covers your consent to receive text messages from us and how to stop them.

    Who We Are

    Sapphire HVAC Solutions Inc is a family owned heating, ventilation, and air conditioning contractor based in Hialeah, Florida, operating under Florida contractor license CAC1824638. In these Terms, "we," "us," and "our" refer to Sapphire HVAC Solutions Inc. "You" and "your" refer to the person or business using our website or requesting service from us.

    Service Area

    We serve Miami-Dade and Broward counties. Availability may vary by location, by season, and by the type of work involved. We may decline a job, refer it to another contractor, or charge additional travel fees for locations near or outside the edge of our normal service area. If you are unsure whether we cover your address, please call us before scheduling.

    Service Requests and Scheduling

    You can request service by phone, by text, or through a form on our website. Submitting a request does not create a confirmed appointment. An appointment is only scheduled once we confirm it with you directly by phone, text, or email.

    We handle each request personally rather than through automatic online booking, so there may be a short wait before we get back to you. We will do our best to respond quickly, but we cannot promise a specific response time or that we will be able to accommodate every request or preferred time slot.

    Estimates and Quotes

    Any estimate or quote we give you is based on the information available to us at the time, which may include what you describe over the phone, photos you send, or what we observe during a visit. Estimates are not final bids unless we clearly say so in writing.

    The final price may change if the actual conditions differ from what we expected. Common reasons include hidden damage, corrosion, undersized or damaged ductwork, electrical problems, access limitations, refrigerant type or quantity, code requirements, or additional parts discovered once the system is opened up. If we find something that may change the price, we will do our best to tell you before we perform that additional work, and you may choose whether to move forward.

    Estimates may expire. Parts pricing, equipment availability, and supplier costs can change without notice, so an older estimate may no longer be accurate.

    Diagnostic and Trip Fees

    A diagnostic fee or trip charge may apply to a service visit. Where a fee applies, we will do our best to tell you the amount before the visit or when we arrive. In some cases we may waive the fee or apply it toward the cost of a repair, at our discretion. A diagnostic fee generally covers our time, travel, and evaluation, and may still apply if you choose not to proceed with the recommended repair.

    Arrival Windows and Delays

    Any arrival time or window we give you is our best estimate, not a guarantee. Traffic, weather, permit or inspection timing, parts availability, and unexpected complications on an earlier job can all cause delays. If we expect to be late or need to reschedule, we will try to contact you at the phone number you gave us.

    Cancellations and Missed Appointments

    If you need to cancel or reschedule, please give us as much notice as you reasonably can. A cancellation fee, rescheduling fee, or trip charge may apply for appointments cancelled on short notice, for missed appointments, or if we arrive and cannot access the property. Where such a fee applies, we will do our best to disclose it in advance. We may also cancel or reschedule an appointment when circumstances require it, including weather, safety concerns, staffing, or equipment issues.

    Property Access and Your Responsibilities

    To perform work safely and correctly, we ask that you:

    • Provide safe, clear, and legal access to the equipment, attic, roof, closet, electrical panel, or other work areas.
    • Have an adult at least 18 years old present, or arrange authorized access, unless we agree otherwise in advance.
    • Secure pets and keep children away from the work area, tools, and equipment.
    • Move or protect valuables, furniture, vehicles, and personal items near the work area.
    • Tell us about known hazards, including mold, asbestos, pests, structural damage, wiring problems, or prior water intrusion.
    • Confirm that you own the property or are authorized to approve the work. If you are a tenant, property manager, or agent, you represent that you have permission from the owner.

    We may pause, reschedule, or decline work if a location is unsafe, inaccessible, or materially different from what was described. Additional charges may apply if extra time or equipment is needed to gain access.

    Pricing and Payment

    Unless we agree otherwise in writing, payment is due when the work is completed. Accepted payment methods may vary and may change over time. For equipment installations, special order parts, or larger projects, a deposit or progress payment may be required before work begins or before materials are ordered. Deposits may be non-refundable once equipment or parts have been ordered.

    Prices shown on our website, in advertisements, or in promotional materials are examples and may change. Coupons, discounts, and promotional offers may have conditions, expiration dates, or exclusions, may not be combined, and may not apply to every job.

    Past due balances may be subject to late fees, interest, collection costs, or reasonable attorney fees to the extent permitted by Florida law. A fee may apply to returned or declined payments. We may also have lien rights under Florida law for unpaid work or materials.

    Parts, Equipment, and Warranties

    Nothing on this page creates a warranty. Where a warranty applies to your job, its terms are stated on the invoice, proposal, or written agreement for that job, and that document controls.

    Equipment and parts may carry a manufacturer warranty. Those warranties are offered by the manufacturer, not by us, and are subject to the manufacturer's own terms, exclusions, timelines, and registration requirements. Some manufacturer warranties require registration within a set time after installation, and some require documented annual maintenance in order to stay valid.

    We may offer a limited workmanship or labor warranty on certain work. Where offered, the length and scope will be stated in writing for that specific job and may differ from job to job.

    Warranty coverage may be reduced, voided, or unavailable in situations such as:

    • Parts or equipment supplied by you or by a third party.
    • Repairs performed on aging systems or components already near the end of their service life.
    • Work performed against our recommendation, or a repair you chose in place of one we advised.
    • Later work, adjustments, or repairs performed by someone else.
    • Misuse, neglect, missed maintenance, dirty filters, or blocked airflow.
    • Power surges, electrical faults, lightning, flooding, storm damage, corrosion, or pests.
    • Unpaid invoices for the work in question.

    Recommendations and System Performance

    Our advice and recommendations are based on what we observe at the time of the visit and on the information you provide. HVAC performance depends on many things outside our control, including the age and condition of the system, ductwork, insulation, windows, roof, humidity levels, home layout, thermostat settings, usage habits, and the electrical supply.

    Because of that, we do not guarantee a specific indoor temperature, humidity level, energy savings, utility bill reduction, efficiency rating, or equipment lifespan. Any figures we mention are estimates or general expectations, not promises of results.

    Permits, Code, and Inspections

    Some work may require a permit or a municipal inspection. If we believe a permit is needed, we will tell you, and permit fees or related costs may be added to your total. Permit and inspection timelines are controlled by the local building department, not by us, and may affect the schedule. Code requirements can also add work or materials that were not part of the original estimate.

    Existing Conditions and Prior Work

    We are not responsible for pre-existing conditions, prior installations or repairs performed by others, existing code violations, or problems that were present before we arrived. Working on older or deteriorated systems carries some risk that a fragile component may fail during service even when the work is performed properly. Where that risk is known and significant, we will try to point it out before proceeding.

    Text Messaging Terms (SMS and MMS)

    Program description

    Sapphire HVAC Solutions Inc operates a text messaging program for customers and prospective customers in the United States. Providing a mobile phone number alone does not constitute consent to receive text messages. You will only receive SMS messages from Sapphire HVAC Solutions Inc when you separately opt in. Messages are sent using an automatic telephone dialing system or other automated technology. Message frequency may vary, and message and data rates may apply. You can reply STOP to opt out or HELP for assistance.

    How you can sign up

    • Review requests. A request for feedback or an online review after a completed job.
    • Promotional messages. Special offers, discounts, coupons, seasonal maintenance reminders, and other marketing messages.

    Message frequency

    Message frequency varies. The number of messages you receive depends on your interactions with us, such as calls, service requests, scheduled appointments, and completed jobs.

    Message and data rates

    Message and data rates may apply. Standard rates from your mobile carrier apply to any message sent or received. Contact your carrier for details about your plan.

    How to opt out

    You can cancel at any time. Reply STOP to any message you receive from us. You may also reply UNSUBSCRIBE, CANCEL, END, or QUIT.

    After you send one of those keywords, we will send you one final message confirming that you have been unsubscribed, and you will not receive further text messages from us unless you sign up again.     Carrier liability

    Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your mobile carrier and is not guaranteed. Our text messaging program may not be supported by every carrier, plan, or device.

    Eligibility and your phone number

    You must be at least 18 years old and must be the account holder of the mobile number you provide, or have the account holder's permission to enroll that number. Please give us an accurate mobile number, and let us know if your number changes or is reassigned so we do not message someone else by mistake.

    Privacy of your mobile information

    No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service and messaging platform providers, is permitted. All other use case categories exclude text messaging originator opt-in data and consent, and this information will not be shared with any third parties.

    Email and Phone Communications

    If you provide your email address, you may receive service related emails such as estimates, invoices, confirmations, and follow ups, and you may receive promotional emails. You can unsubscribe from promotional emails using the link at the bottom of those messages, or by contacting us. We may still send you emails that relate to an active job or an outstanding balance.

    Calls with us may be recorded or monitored for quality and training purposes where permitted by law. If a call is recorded, we will disclose it as required.

    Privacy

    Our Privacy Policy explains what information we collect, how we use it, and the choices you have. By using our website or our services, you also agree to that policy. It is incorporated into these Terms by reference.

    Reviews, Photos, and Feedback

    To the fullest extent permitted by Florida law, our total liability for any claim relating to a particular job will not exceed the amount you actually paid us for that job.

    Indemnification

Where a signed written agreement for a specific job conflicts with these Terms, that job agreement controls for that job. You may not transfer your rights under these Terms without our consent.
